Terms of Service — Agent Basin

Please read these Terms of Service ("Terms") carefully before using Agent Basin ("Service") operated by Agent Basin, Inc. ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Use of Service

You may use Agent Basin only for lawful purposes and in accordance with these Terms. You agree not to use the Service to capture, store, or transmit any data that you do not have the legal right to process, or to violate any applicable laws or regulations.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Data and Privacy

You retain all rights to the agent run data you capture through Agent Basin. By using the Service, you grant us a limited license to store, process, and display that data solely to provide the Service to you. We handle your data in accordance with our Privacy Policy.

4. Acceptable Use

You agree not to:

Use the Service to capture data without the consent of the individuals whose data is being captured
Attempt to reverse-engineer, decompile, or otherwise access the source code of our systems
Use the Service to transmit malware, spam, or other harmful content
Exceed rate limits or attempt to circumvent usage restrictions on your plan

5. Payment Terms

Paid plans are billed monthly in advance. If you exceed the event limit of your plan, you will be notified and given the option to upgrade. We do not automatically charge for overages without your consent.

6. Service Availability

We strive to maintain 99.9% uptime for the Agent Basin platform. Scheduled maintenance will be announced with at least 24 hours notice. We are not liable for downtime caused by factors outside our control.

7. Termination

Either party may terminate the agreement at any time. Upon termination, you will have 30 days to export your data before it is deleted from our systems.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free or uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Agent Basin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.

10. Changes to Terms

We reserve the right to update these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
